Terms of Service

1. Acceptance of Terms

By accessing or using FaxDash (the “Service”), provided by The X Chapter LLC (“Company,” “we,” “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. You must be at least 13 years of age to use the Service.

2. Description of Service

FaxDash is a mobile and web application that enables users to send and receive faxes, scan and enhance documents, add digital signatures and watermarks, and manage fax communications. The Service includes a mobile app (iOS and Android), a web dashboard, and email-to-fax functionality.

3. Accounts

  • You must create an account to use the Service. You may register with email/password, Google sign-in, or Apple sign-in.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must provide accurate and complete information during registration.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Credits and Payments

Send Credits

  • Fax sending requires credits, which are purchased as credit packs through the Apple App Store or Google Play.
  • Credits are deducted based on the number of pages sent.
  • Purchased credits do not expire.
  • Credits are non-refundable except as required by applicable law or app store policies.
  • New accounts receive complimentary credits upon registration.

Receive Subscriptions

  • Receiving faxes requires an active subscription plan, which includes a dedicated fax number.
  • Subscriptions are billed monthly or annually through the Apple App Store or Google Play.
  • Each plan includes a monthly page allowance and bonus send credits.
  • If a subscription lapses, your dedicated fax number may be released after a grace period.
  • Subscription management (cancellation, upgrades, downgrades) is handled through your app store account.

Add-ons

  • Additional fax numbers are available as monthly add-on subscriptions.
  • Add-ons require an active receive subscription.

5. Fax Transmission

  • We use third-party providers to transmit faxes. While we strive for reliable delivery, we do not guarantee that every fax will be successfully delivered.
  • Delivery depends on the recipient's fax machine availability, line quality, and other factors outside our control.
  • Credits are consumed when a fax is submitted for transmission. Failed transmissions may be retried automatically.
  • You are responsible for ensuring you have the right to send documents to the intended recipients.

6. Number Porting

  • You may request to port an existing fax number to FaxDash, subject to carrier approval and porting availability.
  • Porting timelines vary and are subject to your current carrier's processing.
  • We are not responsible for service interruptions during the porting process.

7. Acceptable Use

You agree not to use the Service to:

  • Send unsolicited faxes (spam), including commercial advertising without recipient consent
  • Transmit content that is illegal, threatening, abusive, defamatory, or otherwise objectionable
  • Violate the Telephone Consumer Protection Act (TCPA) or similar regulations
  • Send faxes to emergency service numbers
  • Interfere with or disrupt the Service or its infrastructure
  • Attempt to gain unauthorized access to other users' accounts or data
  • Use the Service for any purpose that violates applicable law

Violation of these terms may result in immediate account suspension or termination without refund.

8. Intellectual Property

  • The Service, including its design, features, code, and branding, is owned by The X Chapter LLC and protected by intellectual property laws.
  • You retain ownership of all documents and content you upload or create through the Service.
  • You grant us a limited license to process, store, and transmit your content solely to provide the Service.

9. Privacy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your information.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT FAXES WILL BE DELIVERED SUCCESSFULLY.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE X CHAPTER LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless The X Chapter LLC from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

13. Modifications

We may modify these Terms at any time. Material changes will be communicated through the app or website. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Termination

  • You may stop using the Service at any time and request account deletion by contacting us.
  • We may suspend or terminate your account for violation of these Terms or for any reason with reasonable notice.
  • Upon termination, your right to use the Service ceases. Unused credits are non-refundable unless required by law.
  • Provisions that by their nature should survive termination (including limitation of liability, indemnification, and governing law) will survive.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in California.
